2. What these terms cover
These terms cover use of our website and access to a Kenz Marketing client account by a business and its authorised users. For client platform access, we provide these terms before access is granted. Your service agreement identifies the version you agree to and incorporates it into the agreed platform arrangements.
Your written service agreement and service schedule set out the work you have ordered, fees, included usage, responsibilities, support, billing, cancellation and handover arrangements. Those agreed documents take priority if they conflict with these general website and platform terms, subject to applicable law.
Sending an enquiry, requesting a demo or signing into the platform does not itself order a paid service, authorise a charge or change an existing agreement. A free trial or pilot has its own agreed scope and continuation terms.
3. Client accounts and authorised users
Use the account assigned to your business and the individual login assigned to you. Your access is limited to the account and permissions agreed for your role. Tell us when a user should be added, removed or given different access.
Keep your login details secure, use the available security protections and tell us promptly if you suspect unauthorised access. Do not share an individual login, access another business's records, or attempt to bypass account permissions.
We may temporarily restrict affected access where reasonably necessary to address suspected compromise, unlawful use or a material security risk. We will explain the reason and the steps needed to restore access as soon as reasonably practicable, unless doing so would compromise security or breach a legal obligation. Payment issues and the ending of a paid service are handled under the service agreement.
4. Using the website and platform
Use our website lawfully. Client platform users must use their account for lawful business purposes within their agreed service. Do not upload malicious software, interfere with other users, send fraudulent or unlawful messages, or use content and contact records without the rights and permissions needed for the intended use.
The client remains responsible for the accuracy of its business information, services, prices, availability, quotes and customer decisions. Agree the approved information, message copy, booking rules and human handover arrangements with us before an automated service starts.
5. Automation, AI and service availability
The features available in your account depend on your agreed package, permissions, connected services and completed setup. A feature shown in a demonstration is not automatically part of your service.
AI responses and automated records can contain errors. Important customer, specialist and financial decisions need appropriate human checking. The platform is not an emergency-response service.
We will perform our agreed work with reasonable care and skill. We do not promise a particular number of enquiries, reviews, bookings, jobs or a financial return. Access can be affected by maintenance, internet connections and third-party service interruptions; we do not promise uninterrupted or error-free operation. This does not remove our obligations under your agreement or applicable law.
6. Content and website ownership
You keep ownership of your domain, supplied content and assets, existing website, business profile and reviews. A website we build for you, including its delivered design and code, belongs to you under the agreed website service. Ending that service does not impose a buyout or a requirement to keep paying to retain the website. Hosting and ongoing management end as set out in your service agreement; ownership does not include indefinite free hosting.
Before agreeing the website build, we agree a usable hosting and handover route, including how you receive and use the delivered design and code. We test that route before delivery. We use a build route that lets us fulfil the agreed ownership and handover arrangements; restrictions in a particular builder do not create a buyout fee or a requirement to keep paying to retain your website.
You give us permission to use the assets and business information you supply to carry out the agreed work. You must have the necessary rights to supply them.
Your client login gives you access to the assigned platform account. It does not transfer ownership of the underlying third-party software. Any separate advertising creative licence is governed by its own written agreement. We need separate permission before using identifiable client material in public case studies.
7. Privacy and client customer data
Our privacy notice explains how we handle our own enquiries and business contacts and identifies the providers we use.
Processing customer information for your business must be covered by the relevant client agreement, data-processing terms, documented instructions and customer notices. These website and platform terms are not a substitute for those documents. Responsibilities depend on the activity and actual processing arrangements.
Agree the records to process, purposes, connected channels, message permissions, access, retention and deletion arrangements before real customer information is used. We will not use your customer records for another client's marketing or publish identifiable customer information without appropriate permission.
8. Leaving the service and keeping your records
Cancellation and any refund are governed by the written service agreement. Agree the practical handover of your website and assets, hosting arrangements, and the available export of customer records before platform access ends. Record formats, timing and any technical limits should be confirmed for the actual service.
Client-owned websites and customer records are not used as leverage in a payment dispute. These terms do not promise transfer of the whole platform account, third-party software or telephone numbers; any proposed transfer needs its own confirmed arrangements. Record retention and deletion follow the agreed instructions and applicable legal obligations.
9. Responsibility and resolving problems
Tell us promptly if you find an account problem or a material error so we can investigate and agree the next step. Contact [email protected].
Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any liability or right that cannot lawfully be excluded. Any additional allocation or limitation of liability must be stated in the written service agreement and comply with applicable law.
10. Changes and governing law
We will give existing clients reasonable notice of material proposed changes to these platform terms. Updates do not retrospectively change agreed prices, service scope or accrued rights. Changes to an existing service agreement require the agreement provided for in that contract.
If you do not accept a proposed material change, you can end the service under your agreement's notice terms.
These terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, subject to any mandatory rights or jurisdiction rules that apply.
